Best short guide By Phillip Taylor MBE THIS BOOK REMAINS THE BEST SHORT GUIDE FROM APIL ON PERSONAL INJURY PROCEDURESAn appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green ChambersThe Association of Personal Injury Lawyers (APIL) teamed up with Jordan Publishing a little while time ago to produce some first class material for PI professionals and advisers in this highly charged area of the law of tort. These works are of great assistance to us and the guide to PI procedures now in a second edition is particularly welcome as we continue to grapple with the increasing pressures of the CPR and PDs.This particular guide is now an established work which offers both practical and straightforward guidance for all lawyers and advisers conducting personal injury cases and will be of great assistance to the expanding group of litigants in person (LIPs) who now fill the courts since the virtual abolition of legal aid in civil matters. The guide serves equally as an introductory text for newly qualified practitioners, a great asset for LIPs and a brilliant aide-memoire for the more experienced practitioner where time is not on his or her side. The book takes the reader through every procedural step of a standard PI claim providing details of the applicable and relevant procedures. It focuses on the most common problems we face and offers great insight into relevant and current case-law authorities. The author, John McQuater, has updated this new edition to focus on the main substantive areas including the following: the new RTA claims process; recent developments in Part 36 matters which have just been changed and modified again (this has really become very complex and there are numerous cases to deal with which the author has selected with great care); recent cases on disclosure, including the concept of 'proportionality' (for common law lawyers that means in simple English the ‘reasonableness’ test) in connection with privacy, e-document and the latest on videos and surveillance. What we found particularly helpful was the in-depth examination of where we are today with expert evidence and a review of the cases considering when, in PI litigation, this becomes 'reasonably required'.There are also numerous other procedural points including developments on setting judgment aside, service and changes to the CPR which can be read alongside our main practice books depending upon which one you take to court. All in all, John McQuater has given everything we need to know about in one focal point before any detailed legal research might need to be undertaken. Thank you John and APIL- we appreciate the work which has gone in to this new edition. The law is stated as at 2015.
