An in-depth examination By Phillip Taylor MBE AN IN-DEPTH EXAMINATION OF THE ARENA WHERE SERIOUS CRIMINAL OFFENCES ARE PROSECUTED AND SENTENCEDAn appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green ChambersThere are not that many publications available today which have examined in detail the working of the Crown Court since its establishment in the 1970s. So, “Inside Crown Court” is to be welcomed as it presents the findings of a 20-month qualitative study of the Crown Court which was funded by the Economic and Social Research Council.We are not at all surprised by the findings in this book and the final chapter 8, “Conclusions”, sets out what both advocates and the general public would find of greatest interest. The three authors, Jessica Jacobson, Gillian Hunter and Amy Kirby, state that the greatest challenge “lies in the fact that defendants’ marginalization and passive acceptance are likely to have roots much deeper than the way the criminal justice system operates”. These are probably the key findings which give the book such relevance and resonance for current applied criminologists, researchers and those involved at any level with the Crown Court.Between the years 2005 and 2010 some limited government research was conducted into the experiences of court users and we remember some of the forms we completed at the time at court. Unfortunately, the cuts have resulted in a shelving of much valuable feedback although the Witness and Victim Experience Survey (WAVES) was initially established and will hopefully be re-started amid continuing concerns about the position and plight of ‘victims’ within the criminal justice process as the issues rises up the political agenda.In essence, “Inside Crown Court” is a research book which will be of great value to a wide range of readers both legal and general. It should be read by all users of the system as well as undergraduates, academics, Home Office and Ministry of Justice policy-makers and legal practitioners. It’s particularly relevant to criminologists as probably the foremost research paper on where we have come with the creation and operation of Crown Courts in the last 40 years.The book runs to about 250 pages and has eight chapters. The crucial chapter for Counsel is Chapter 5 on ‘structured mayhem’ which just about sums up some of the chaotic and frankly unprofessional ways in which court proceedings appear to be conducted. Talleyrand once said of the Bourbon kings of France that ‘they had learned nothing and forgotten nothing’ and we felt this possibly an apt summing up of the state of the Crown Court today where there is an urgent need for immediate reform.It is to be hoped that the current re-shaping of justice under the initiative of Lord Thomas LCJ which began in the spring of 2014 will pay some attention to the findings of this survey and actually learn something which can be constructively used from the excellent Appendix which details observed cases. The day will come when all proceedings are video recorded (possibly not for public consumption after the Pistorius Trial and its implications) and we might just, as the public, see some meaningful changes.It will be a tribute to the 3 applied criminologists who wrote this book if some of what has been highlighted can be acted upon after 7th May 2015. We will wait and see! Meanwhile this book is a great example of why we need much more public legal education on what we, as practitioners do: “Inside Crown Court” is a great start on this new road if an incoming government grasps the nettle.
